In order to use the Service, you may be required to provide information about yourself including your name, email address, username and password and other personal information. You agree that any registration information you give to Carla Biesinger will always be accurate, correct and up to date. Refusal of Service

Carla Biesinger reserves the right to refuse service to any order, person or entity without obligation to assign reason for doing so. Carla Biesinger reserves the right to limit the number of participants in any given online class or workshop. Carla Biesinger may at any time change or discontinue any aspect or feature of the Site or Service.

Order Confirmation

We will email you to confirm the placement of your order and with details concerning product or service delivery. In the event that there is an error in this email confirmation, it is your responsibility to inform us as soon as possible.

If you’ve signed up for a subscription with us, the subscription renews automatically and your credit card will be charged fees stated at the time of purchase (or the introductory rate during introductory period). Price may change at the end of your subscription period. Your subscription will start as soon as your credit card is successfully charged.

If you have signed up for an online class or workshop, confirmation that we have received your order and payment does not constitute acceptance into the class or workshop. We will email you separately to confirm that you have been accepted into the class or workshop.

If you have submitted a deposit or payment in full for a service, Carla Biesinger has the exclusive right to deny service if deemed necessary. If service is denied, a refund will be provided in full.

Terms

By accessing this website, you are agreeing to be bound by these website Terms and Conditions of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this website are protected by applicable copyright and trademark law.

Refund Policy

9.1 Refund Policy for Instagram Secrets To Success

Our refund policy is as follows:

If you request a refund and do not include your coursework by the end of the Refund Period, you will not be granted a refund.

A full refund will only be given if requested within 60 days of purchasing the course, AND if the student can prove that they did the work, implemented the strategies, and still didn't see any results.

Refunds based on a change of mind will not be granted.

You must submit ALL of the following items with your request for a refund:

  • Requirement 1: A screenshot showing 100% completion of all video lessons.

  • Requirement 2: A screenshot of your Instagram bio created according to the course lesson.

  • Requirement 3: A screenshot of your planned-out posts inside the Plann app (showing min 12 posts).

  • Requirement 4: Completed course workbook

  • Requirement 5: Hashtags sets (min. 2 sets of 30 hashtags each according to the lessons)

  • Requirement 6: Proof of active participation in the Instagram Secrets To Success Community Group on Facebook

Please note: If you opted for a payment plan and you do not request a refund within the Refund Period, with the required coursework at the time of your refund request, you are required by law to complete the remaining payments of your payment plan.

Upon determining that you are entitled to a refund pursuant to this policy, the Company will promptly issue an instruction to its payment processor to issue the refund. The Company does not control its payment processor and will not be able to expedite any refunds.

If you receive a refund of any purchase through this money-back guarantee, that shall immediately terminate any and all licenses granted you to use the material provided to you under this Agreement and the Company’s Terms of Use. You shall immediately cease using the material and shall destroy all copies of the information provided to you, including without limitation: video recordings, audio recordings, forms, template documents, slide shows, membership areas, social media groups limited to paying members, and other resources.

Since we have a clear and explicit Refund Policy in these Terms & Conditions that you have agreed to prior to completing the purchase of the Program, we do not tolerate or accept any type of threat, chargeback threat, or actual chargeback from your credit card company or payment processor

9.4. Refund Policy for Passive Income Accelerator:

We offer a 30-day refund policy so you can go through the content and if you show us your work and prove that it didn't work for you, we will refund your payment.

Our refund policy is as follows:

You must submit ALL of the following items with your request for a refund:

  • Completed course workbook & Course/Program MVP workbook

Product Description

We endeavor to describe and display the Service as accurately as possible. From time to time we may correct errors in pricing and descriptions, because we might not have drunk enough coffee the day we published something. Carla Biesinger does not claim ownership of Material you supply to Carla Biesinger. However, the act of posting Material to the site conveys an irrevocable, worldwide license to Carla Biesinger to use and distribute the posted Material in connection with Carla Biesinger’s website and any related Carla Biesinger publications. You retain copyright ownership and any other rights you may rightfully hold in any content that you submit through the Service. By submitting Material to Carla Biesinger, you agree to hold Carla Biesinger harmless from and against all claims, liabilities and expenses arising out of any potential or actual copyright or trademark misappropriation or infringement claimed against you.

In no event shall Carla Biesinger’s cumulative liability to you exceed the total purchase price of the Service you have purchased from Carla Biesinger, and if no purchase has been made by you Carla Biesinger’s cumulative liability to you shall not exceed EUR100.

Waiver

No waiver of any of the provisions of this Agreement by Carla Biesinger shall be deemed, or shall constitute, a waiver of any other provision, whether or not similar, nor shall any waiver constitute a continuing waiver. No waiver shall be binding unless executed in writing by Carla Biesinger.

Recovery of Litigation Expenses

If any legal action or any arbitration or other proceeding is brought for the enforcement of this Agreement, or because of an alleged dispute, breach, default, or misrepresentation in connection with any of the provisions of this Agreement, the successful or prevailing party or parties shall be entitled to recover reasonable attorneys’ fees and other costs incurred in that action or proceeding, in addition to any other relief to which it or they may be entitled.

Severability

If any term, provision, covenant, or condition of this Agreement is held by an arbitrator or court of competent jurisdiction to be invalid, void, or unenforceable, the rest of the Agreement shall remain in full force and effect and shall in no way be affected, impaired, or invalidated.

Assignment

These Terms and Conditions bind and inure to the benefit of the parties’ successors and assigns. These Terms and Conditions are not assignable, delegable, sub licenseable or otherwise transferable by you. Any transfer, assignment, delegation or sublicense by you is invalid.

Governing Law 

This Agreement shall be governed by and construed in accordance with the laws of the Island of Malta, without regard to its choice-of-law or conflict-of-law provisions and the Parties irrevocably submit to the non-exclusive jurisdiction of the Courts of the Island of Malta as regards any matter or claim relating to these Terms and Conditions.
